    The Committee on the Judiciary moved to amend the bill by striking out everything after the enacting section and inserting in lieu thereof the following:

ARTICLE 6. GENERAL CONSUMER PROTECTION.

§46A-6-111. Jury trial waiver to be a separate document.

    (a) Every written agreement containing a waiver of a consumer’s right to a trial by jury that is entered into by a consumer for the purchase or lease of goods or services in consumer transactions, must have as a separate and stand alone document the waiver of the consumer’s right to a trial by jury.

    (b) Nothing in this section may be construed to require a court of competent jurisdiction to determine that the entire consumer transaction or any portion thereof is enforceable, unenforceable, conscionable or unconscionable.

    (c) This section applies to all contracts entered into on or after January 1, 2015.
